On February 10, the Drug Controller General of India (DCGI) issued show-cause notifications to over 20 online pharmacies, including Amazon and Flipkart. The Confederation of All India Traders (CAIT), a trade association, applauded the national drug regulators action.
The notification sent to the e-pharmacies by the DCGI stated that there are multiple cases in various courts asking for the prohibition of medicine sales online. The operations of these organizations are allegedly in violation of the injunction issued by the Delhi High Court on December 12, 2018, in the case of Dr. Zaheer Ahmed vs. Union of India & Others. The Delhi High Court determined that the "online sale of pharmaceuticals without a license" is prohibited in the aforementioned case.
Earlier this year, Mr. BC Bhartia, the national president of CAIT, and Mr. Praveen Khandelwal, the secretary general, demanded that the law and the ruling issued by the Delhi High Court be strictly enforced.
Additionally, they also asked for assurances that no online retailer will be permitted to sell medications in violation of the Drug and Cosmetic Act. Furthermore, the association asked for stern action against e-commerce platforms and intermediaries like Amazon and Flipkart that were selling drugs without the necessary licenses.
